ACREAGENT ACCEPTABLE USE POLICY

PURPOSE
This Acceptable Use Policy ("AUP") defines prohibited activities and uses of AcreAgent services. By using AcreAgent, you agree to comply with this AUP.
VIOLATION OF THIS AUP MAY RESULT IN IMMEDIATE ACCOUNT SUSPENSION OR TERMINATION WITHOUT REFUND.
1. PROHIBITED ACTIVITIES
You may NOT use AcreAgent for any of the following purposes:
1.1 Illegal Activities

Any activity that violates federal, state, or local laws

Fraud, scams, or deceptive business practices

Money laundering or financing illegal activities
-
Identity theft or impersonation
-
Stalking, harassment, or threats
-
Distribution of illegal content (child exploitation, terrorism, etc.)
1.2 Call Recording Violations

Failing to ensure call recording compliance in states that require all parties to consent ("two-party consent states") where additional consent may be required beyond automatic notice
-
Recording calls for illegal or unethical purposes
-
Using call recordings in ways not disclosed to callers
Note: AcreAgent automatically notifies all callers that calls are being recorded. However, some states require all parties to consent to recording. You are responsible for ensuring compliance with your state's requirements.
1.3 Harassment & Abuse

Harassing, threatening, or abusing callers
-
Using profane, abusive, or offensive language with callers
-
Discriminating against callers based on race, religion, gender, disability, or other protected classes
-
Engaging in any form of bullying or intimidation
1.4 Data Misuse
-
Selling or sharing caller data without proper consent
-
Using caller data for purposes beyond what was disclosed
-
Violating GDPR, CCPA, or other data privacy laws
-
Accessing or attempting to access data belonging to other AcreAgent users
-
Scraping or harvesting data from AcreAgent systems
1.5 System Abuse
-
Attempting to hack, breach, or compromise AcreAgent systems
-
Using AcreAgent to launch cyberattacks or distribute malware
-
Reverse engineering, decompiling, or modifying AcreAgent software
-
Overloading systems with excessive requests or traffic
-
Sharing account credentials or allowing unauthorized access
-
Creating multiple accounts to circumvent usage limits
1.6 Intellectual Property Violations

Using AcreAgent to infringe copyrights, trademarks, or patents
-
Distributing pirated or unauthorized content
-
Impersonating AcreAgent or Equinox Solutions
-
Using our branding, logos, or trademarks without permission
1.7 Financial Crimes
-
Credit card fraud or payment fraud
-
Chargebacks initiated in bad faith
-
Money laundering or terrorist financing
-
Ponzi schemes, pyramid schemes, or investment fraud
1.8 Unethical Business Practices
-
Bait-and-switch tactics with callers
-
False advertising or deceptive marketing
-
Misrepresenting your business, products, or services to callers
-
Violating consumer protection laws
-
Engaging in unfair or predatory business practices
IMPORTANT NOTE ON YOUR MARKETING ACTIVITIES:
While AcreAgent itself does NOT make outbound calls and does NOT violate telemarketing laws, YOU may be conducting marketing activities (direct mail, outbound cold calling, ads, etc.) to generate the inbound calls that AcreAgent answers.
YOU remain solely responsible for compliance with all laws governing YOUR marketing methods, including:

Telephone Consumer Protection Act (TCPA) for any outbound calls YOU make

Telemarketing Sales Rule (TSR) for any telemarketing YOU conduct
-
Do Not Call (DNC) Registry requirements for YOUR outbound calling
-
CAN-SPAM Act for any email marketing YOU send
-
Any state or local marketing regulations
AcreAgent is NOT responsible for violations of laws related to YOUR marketing activities.
2. COMPLIANCE REQUIREMENTS
2.1 Call Recording Compliance
ALL CALLERS ARE AUTOMATICALLY NOTIFIED that calls are being recorded.
AcreAgent automatically provides verbal notice at the beginning of each incoming call. However, YOU remain responsible for ensuring this meets legal requirements in your jurisdiction.
Federal Law (One-Party Consent):

Federal law allows recording with just one party's consent (yours)

This applies to incoming calls in most states
-
Automatic notice is provided as best practice
Two-Party Consent States:
Some states require ALL parties to consent to recording. In these states, you may need additional consent mechanisms beyond the automatic notice we provide.
Your Responsibility:
You are solely responsible for compliance with call recording laws in your jurisdiction. We provide the automatic notice as a baseline, but you must ensure it meets your specific legal requirements.
If your specific state or jurisdiction requires additional verbal consent or other recording requirements beyond our automatic notice, please contact support@equinoxvoice.com to discuss your needs.
2.2 Data Privacy Compliance
You MUST:

Comply with GDPR, CCPA, and other applicable data privacy laws

Obtain proper consent before collecting or using caller data
-
Provide privacy notices explaining how caller data will be used
-
Maintain appropriate data security measures
-
Honor data subject requests (access, deletion, correction, etc.)
2.3 CRM Compliance
You MUST:

Ensure your CRM credentials are secure
-
Only integrate AcreAgent with CRMs you own or have authorization to access
-
Comply with your CRM provider's terms of service
-
Backup your CRM data regularly
2.4 YOUR Marketing Compliance (If Applicable)
While AcreAgent does NOT make outbound calls, YOU may be conducting marketing to generate inbound calls.
If you conduct outbound marketing (direct mail, cold calling, ads), YOU MUST comply with:

AcreAgent is NOT responsible for violations of laws related to YOUR marketing methods. We only answer the incoming calls those marketing efforts generate.
3. MONITORING & ENFORCEMENT
3.1 Our Right to Monitor
We reserve the right to:

Monitor call recordings for quality assurance and compliance
-
Review account activity for suspicious or prohibited behavior
-
Investigate complaints or reports of AUP violations
-
Suspend or terminate accounts that violate this AUP
3.2 Reporting Violations
If you become aware of AUP violations by other users, report them to:

3.3 Consequences of Violations
If you violate this AUP, we may:

Issue a warning

Temporarily suspend your account

Permanently terminate your account without refund

Report violations to law enforcement or regulatory agencies

Take legal action to recover damages
-
Ban you from future use of AcreAgent
TERMINATION FOR AUP VIOLATIONS DOES NOT ENTITLE YOU TO A REFUND.
4. LEGAL COOPERATION
4.1 Law Enforcement Requests
We cooperate with law enforcement and regulatory agencies. If we receive a valid legal request (subpoena, warrant, court order), we may:

Provide account information

Share call recordings and transcriptions

Disclose usage data and analytics
-
Testify or provide evidence in legal proceedings
4.2 Regulatory Compliance
We comply with requests from regulatory agencies, including:

Federal Trade Commission (FTC)

State Attorneys General
-
Consumer protection agencies
-
Data protection authorities (GDPR, CCPA)
5. DISCLAIMER OF LIABILITY
YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF ACREAGENT.
We are NOT responsible for:

Your compliance with telemarketing, call recording, or data privacy laws
-
Any legal claims or regulatory actions resulting from your use of AcreAgent
-
Damages caused by your violations of this AUP
-
Harm to third parties resulting from your actions
-
Fines, penalties, or legal costs you incur
BY USING ACREAGENT, YOU INDEMNIFY AND HOLD US HARMLESS FROM ANY CLAIMS ARISING FROM YOUR VIOLATIONS OF THIS AUP.
6. UPDATES TO THIS AUP
We may update this AUP at any time to reflect:

Changes in applicable laws

New prohibited activities
-
Service improvements or expansions
When we update this AUP, we will:

Update the "Last Updated" date
-
Notify you via email or in-app notification
-
Post the updated AUP on our website
Continued use of AcreAgent after updates constitutes your acceptance of the revised AUP.
